Whether the so-called “extender” provision of the Housing and Economic Recovery Act of 2008 (HERA) extends the applicable three-year statute of repose for claims brought under Sections 11 and 12 of the Securities Act of 1933, thereby allowing a federal agency to proceed with claims brought four to six years after the relevant securities were purchased.
