SIFMA and NetCoalition provide comments to the Securities and Exchange Commission (SEC) petitioning for suspension and disapproval NASDAQ’s proposal to establish an Enhanced Display Distributor Fee, File No. SR-Nasdaq-2012-005, Exchange Act Release No. 66165. Because NASDAQ’s actions are inconsistent with the United States Court of Appeals for the District of Columbia Circuit’s opinion in NetCoalition v. SEC, the groups respectfully request that the SEC suspend the rule change and institute proceedings to disapprove.
