Whether the safe harbor provision in Section 546(e) of the Bankruptcy Code, which limits the bankruptcy trustee’s powers to avoid (i.e., unwind) transfers made as “settlement payments” or transfers that are “in connection with” a “securities contract,” is applicable to transfers made by Bernard L. Madoff Investment Securities (BLMIS) to BLMIS customers.
