Whether a defendant can rebut the inflation maintenance theory of the fraud on the market presumption of reliance at class certification by showing that back-end disclosures didn’t actually correct front-end alleged misstatements (as the Second Circuit has held), or whether it is enough that the back-end disclosures are about the same general subject matter as the alleged front-end misstatements (as the Third and Ninth Circuits have held).
