Amicus Issue:

Whether Section 1964(c) of the Private Securities Litigation Reform Act (PSLRA) – which bars plaintiffs from bringing RICO claims that rely on “conduct” that “would have been actionable as fraud in the purchase or sale of securities” – applies (as prior federal appellate courts have held) so long as the conduct complained of is actionable as securities fraud, even if the particular RICO plaintiff would not have a viable claim.
