Proposed Amendments to the Discovery Guide

SIFMA provides comments to the Securities and Exchange Commission (SEC) on the proposed amendments to the Discovery Guide, File No. SR-FINRA-2008-024. The Discovery Guide’s purpose is to serve as a guide to ensure that all relevant material is exchanged, and also ensure that the parties and arbitrators retain the flexibility to alter the types of materials exchanged based upon the particular claims at issue. While SIFMA generally supports the goal of improving the discovery process, there are several proposed amendments that should be revised to ensure that the Discovery Guide better serves its stated purpose.
