SIFMA provides comments to the Securities and Exchange Commission (SEC) Regarding  Notice of Filing and Immediate Effectiveness of Proposed Rule Change by The NASDAQ Stock Market LLC to Revise an Optional Depth Data Enterprise License Fee for Broker-Dealer Distribution of Depth-of-Book Data, File No. SR-Nasdaq-2010-125, Exchange Act Release No. 63084.  SIFMA believes the exchange’s actions are inconsistent with the recent decision of the United States Court of Appeals for the District of Columbia Circuit in NetCoalition v. Securities and Exchange Commission.
