Recapitalizations & the Orderly Liquidation Authority of Dodd-Frank

SIFMA and The Clearing House (TCH) provide comments to the Federal Deposit Insurance Corporation (FDIC) on the FDIC’s Second Notice of Proposed Rulemaking under Title II of the Dodd-Frank Wall Street Reform and Consumer Protection (Dodd-Frank Act), FR Docket No. 2011-6705. The proposal would implement certain provisions of the orderly liquidation authority contained in Title II of the Dodd-Frank Act by using recapitalizations as a way to resolve systemically important banks and non-bank financial companies on a closed basis without taxpayer-funded bailouts.
