SIFMA and NetCoalition provide comments to the Securities and Exchange Commission (SEC) petitioning for disapproval of the Notice of Filing and Immediate Effectiveness of Proposed Rule Change to Extend Fee Pilot Program for NASDAQ Last Sale, File No. SR-NASDAQ-2012-078, Exchange Act Release No. 67376, 77 Fed. Reg. 41467.  The proposal would extend for three months the fee pilot for distribution of Nasdaq Last Sale market data products.  The groups believe that NASDAQ’s actions are inconsistent with the recent decision of the United States Court of Appeals for the District of Columbia Circuit in NetCoalition v. Securities and Exchange Commission.
