New Fees for PHLX Top of Options Data Product

SIFMA and NetCoalition provide comments to the Securities and Exchange Commission (SEC) petitioning for disapproval of the proposal by NASDAQ OMX PHLX LLC to establish news fees for its” managed data solution” Top of Options (TOPO) data product, File No. SR-PHLX-2012-93, Exchange Act Release No. 34-67466.  The groups note that the Exchange’s actions are inconsistent with the decision of the United States Court of Appeals for the District of Columbia Circuit in NetCoalition v. SEC.
