Nasdaq’s Proposal to Revise an Optional Depth Data Enterprise License Fee

SIFMA and NetCoalition provide comments to the Securities and Exchange Commission (SEC) on a proposed rule change by The Nasdaq Stock Market LLC (Exchange) to revise an optional depth data enterprise license fee for broker-dealer distribution of depth-of-book data, File No. SR-NASDAQ-2011-21, Exchange Act Release No. 63892. The groups believe the Exchange’s actions are inconsistent with the recent decision of the United States Court of Appeals for the District of Columbia Circuit in NetCoalition v. Securities and Exchange Commission and petition the SEC to temporarily suspend the rule change.
