Proposal to Add Routing Option SOLV & a Related Fee

SIFMA and NetCoalition provide comments to the Securities and Exchange Commission (SEC) on The Nasdaq Stock Market’s (Exchange’s) proposed rule change to add routing option SOLV and corresponding fees, File No. SR-Nasdaq-2011-023, Exchange Act Release No. 63893.  The groups believe that the Exchange’s actions are inconsistent with the recent decision of the United States Court of Appeals for the District of Columbia Circuit in NetCoalition v. Securities and Exchange Commission, and petition the SEC to temporarily suspend the rule change.
