SIFMA submitted an Amicus “Friend of the Court” Brief. The September 29 amicus brief is the first of two amicus briefs filed by SIFMA in Microsoft v. i4i Limited Partnership. SIFMA filed a second amicus brief in Microsoft v. i4i Limited Partnership on February 2, 2011.

Amicus Issue: Whether, when a defense of patent invalidity rests on documentary evidence that was not considered by the Patent and Trademark Office (PTO), the defense must be proved by clear and convincing evidence, or whether some lesser evidentiary standard is more appropriate.
