(1) Whether the so-called “extender provision” found in the Housing and Economic Recovery Act of 2008 (HERA) extends the applicable statute of repose for claims brought under Sections 11 and 12 of the Securities Act.  (2) Whether HERA’s extender provision applies to claims brought under federal law.
