Amicus Issues:  

Whether a foreign claimant who entered into transactions with a foreign affiliate of a broker-dealer is a “customer” of the broker-dealer, as that term is used in FINRA Rule 12200, such that the claimant can compel the firm to arbitrate a dispute between the parties in the FINRA arbitration forum.
